1. Acceptance of Terms

By accessing or using CyberB's website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Service Description

CyberB provides cybersecurity services including but not limited to:

  • Security Operations Center (SOC) services
  • Penetration testing and vulnerability assessments
  • Incident response and digital forensics
  • Managed Detection and Response (MDR)
  • Compliance consulting and auditing
  • Cybersecurity training and awareness programs
  • Red and blue team exercises
  • Cloud and application security services

3. Service Agreements

Specific cybersecurity services are governed by separate Service Agreements that include:

  • Scope of work and deliverables
  • Service level agreements (SLAs)
  • Pricing and payment terms
  • Confidentiality and data protection requirements
  • Access and authorization procedures
  • Incident response protocols

These Terms of Service supplement, but do not replace, individual Service Agreements.

4. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information
  • Grant necessary access for service delivery
  • Maintain appropriate security measures
  • Follow our recommendations and best practices
  • Notify us of any security incidents or changes
  • Comply with applicable laws and regulations
  • Pay fees according to agreed terms

5. Confidentiality

We understand the sensitive nature of cybersecurity information and commit to:

  • Maintaining strict confidentiality of all client information
  • Using client data only for authorized service delivery
  • Implementing appropriate security controls for data protection
  • Requiring confidentiality agreements from all personnel
  • Following industry standards for data handling

Confidentiality obligations survive termination of our service relationship.

6. Service Availability

While we strive for high availability, we cannot guarantee uninterrupted service due to:

  • Scheduled maintenance and updates
  • Network or infrastructure issues
  • Force majeure events
  • Security incidents affecting our systems
  • Third-party service dependencies

Service level commitments are specified in individual Service Agreements.

7. Limitation of Liability

To the maximum extent permitted by law, CyberB shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the fees paid for services
  • Security incidents not caused by our negligence
  • Third-party actions or system failures

This limitation applies regardless of the theory of liability.

8. Intellectual Property

Rights and ownership are allocated as follows:

  • Clients retain ownership of their data and systems
  • CyberB retains ownership of methodologies and tools
  • Reports and assessments may include both parties' IP
  • General threat intelligence may be shared (anonymized)
  • Neither party may use the other's trademarks without permission

9. Payment Terms

Standard payment terms include:

  • Invoices are due within 30 days of receipt
  • Late payments may incur interest charges
  • Services may be suspended for non-payment
  • Disputed charges must be reported within 30 days
  • Refunds are subject to Service Agreement terms

10. Termination

Either party may terminate services:

  • For convenience with 30 days' notice
  • Immediately for material breach
  • For non-payment after cure period
  • If required by law or regulation

Upon termination, we will securely return or destroy client data as specified in the Service Agreement.

11. Compliance and Legal Requirements

We comply with applicable laws and regulations, including:

  • Data protection and privacy laws
  • Industry-specific regulations
  • Professional licensing requirements
  • International trade restrictions
  • Incident reporting obligations

12. Dispute Resolution

Disputes will be resolved through:

  • Good faith negotiation between parties
  • Mediation if negotiation fails
  • Binding arbitration as final resort

13. Changes to Terms

We may update these terms with notice:

  • 30 days' advance notice for material changes
  • Email notification to registered users
